Navigating compliance while investigating

An employer must ensure they follow a fair procedure for everyone involved in the grievance or disciplinary investigation.
Any decisions made must follow a reasonable investigation. If it doesn’t, the case is likely to be deemed unfair, risking legal action.
While organisations can follow their own workplace investigation process, as a minimum, workplace investigations have to meet the requirements under the ACAS Code of Practice on disciplinary and grievance procedures to be deemed fair and lawful.
